Privacy Policy / Handling of Personal Information

Crédit Agricole Securities Asia B.V., Tokyo Branch Crédit Agricole Securities, Tokyo Branch (hereinafter “the Branch”) is committed to the proper handling of customers’ personal information in line with the “Act on the Protection of Personal Information (PDPL),” “Act on the Use of Numbers to Identify a Specific Individual in Administrative Procedures (Individual Number Law” and any other applicable laws, regulations and guidelines. The Branch will not use personal information for the purposes other than its intended purpose without the consent of the customer. We will also make every effort to ensure prompt and sincere responses to any inquiry and/or concern from customers regarding the protection of personal information.

1. Purpose of Using Personal Information

The Branch may acquire/use personal information to allow for the sound and secure processing of transactions, and to ensure that customers receive the highest level of financial products and services.
Following financial products and services are those handled by the Branch;

(1) Financial instruments business (intermediary, brokerage or agency service for sale and purchase of securities or transactions of derivatives, or underwriting or management of securities) and any other business incidental to financial instruments business
(2) Other business financial instruments business operators may engage in pursuant to relevant laws, including business pertaining to money lending, and any other business incidental to the above
(3) Other business financial instruments business operators may engage in and any other business incidental to the above (including business we may be permitted to operate in the future)

The Branch may use personal information for the following purposes with respect to the above financial products and services:

1) To perform or solicit transactions and related services concerning securities or any other financial products handled by the Branch pursuant to the Financial Instruments and Exchange Law,
2) To perform or solicit transactions and related services or make advertisement concerning financial products handled by the Branch or by the affiliates (including products the Branch may be permitted to handle in the future),
3) To review suitability for solicitation in connection with any of our financial products or services, in light of the laws and regulations, our internal rules and the suitability rule, etc.,
4) To check customer’s or his/her agent’s personal identification,
5) To inform or advise customers of performance results and account balances concerning financial products offered to the customers or of seminars, etc,
6) To perform back-office functions for transactions with customers,
7) To research or develop financial products and services provided by or to be provided by us by using market research, data analysis or customer surveys,
8) To properly carry out any outsourcing services, if we are requested by a third party to handle part or all of such third party’s personal information,
9) To fulfill statutory obligations under the laws and regulations and requirements under the rules of the industry associations,
10) To contact the customer as deemed necessary for performing our business operations, and;
11) For any other purposes to enable us to adequately and smoothly provide our services to customers.

2. Types of Personal Information to be Acquired

The Required personal information may include the name, address, date of birth, gender, telephone number, and email address, in addition to the information given to us at the time of entering the business relationship.
We would never obtain sensitive information of the customer without prior consent.
Also we would not collect or store any specific personal information, in principle, except for those set forth in the applicable laws and regulations.

3. Personal Information Acquisition Method

The Branch may acquire personal information by using post, internet, telephone, and any other electronic devices. The Branch shall enforce adequate security measures to protect the confidentiality of all personal information.

4. Provision of Personal Information

1) The Branch shall not utilize personal information to the third parties, except as described below;

  • When the Branch have obtained customer’s consent,
  • When deemed necessary pursuant to applicable laws and regulations,
  • When deemed necessary for the customer or the public interest,
  • When suggesting financial products or service offerings that may be of interest to the customer,
  • When entrusting personal information with a third party in outsourcing some of our services (in this situation, the Branch shall conduct thorough due diligence on such third party, and shall take all appropriate measures pursuant to the applicable laws and regulations), and;

2) Customer’s specific personal information will be used only for the operations stipulated in the applicable laws and regulations.

5. Third Party Provision on Personal Information

The Branch shall not provide personal information to the third parties, except as described below;

  • When the Branch has obtained customer’s consent,
  • When entrusting personal information under the requirements prescribed in the applicable laws and regulations,
  • When deemed necessary pursuant to applicable laws and regulations,
  • When deemed necessary for the customer or the public interest,
  • When information is shared within Crédit Agricole Group (Crédit Agricole CIB Paris and its branches, Amundi Japan Ltd., etc) to perform the full range of financial services and to manage any affiliated risks.
6. Personal Information Management Method

The Branch shall take appropriate measures to ensure that personal information is kept accurate and up to date. The Branch shall also take appropriate security measures, such as limitations on computer accesses and countermeasures on computer viruses, in order to prevent the loss, destruction, falsification, and/or leakage of personal information.
The Branch shall ensure that any agent or service provider of the Branch which handles personal information of the Branch’s customers shall also maintain strict controls over such personal information to ensure confidentiality.

7. Request of Disclosure/Correction/Discontinuation from the Customer

The Branch shall respond to customer’s requests for the disclosure of their own personal information, after confirming the identity of the requesting party. The Branch shall make the necessary amendments if the customer informs the Branch that any information is inaccurate. As necessary, customer may request the Branch to dispose of the personal information held by the Branch.
Customers may direct such requests to the Inquiries Desk referred to hereunder in Article 7.

8. Customer Inquiries and Complaints Desk

Customers may direct all applications relating to the disclosure, correction, discontinuation, as well as any other inquiries or complaints about the administration of the Branch to the following desk;

9. Disclosure and Modification

This Privacy Policy is available at the Branch’s reception and on the Branch’s website. The Branch may amend the Policy in accordance with the revision of applicable laws and regulations or any other reasons. Such amended Policy will be also disclosed in the same way described above.

10. Authorized Personal Information Protection Organization

The Branch is a member of the Japan Securities Dealers Association ("JSDA"), an Authorized Personal Data Protection Organization. JSDA’s Personal Information Consultation Office may advise on any inquiry and/or complaint regarding personal information handled by JSDA members.
